Donald Trump is seeking to disqualify Obama-appointed District Judge Tanya Chuktan from presiding over his election subversion case.
Lawyers for the Republican frontrunner filed a motion on Monday claiming Ms Chuktan’s prior statements about the former president raise questions about her impartiality in the case.
Ms Chuktan, a former assistant public defender who was nominated to the bench by President Barack Obama, has stood out as handing the toughest sentences to Jan 6 defendants.The request is a long shot given the high threshold for recusal and because the decision on whether to recuse belongs to Ms Chutkan, who is unlikely to see cause to step aside from the case.
Mr Trump, 77, argued in a court filing that prior statements made by Ms Chutkans prior appear to refer to his role in influencing the Jan 6 attack on the US Capitol by his supporters.
