 A man who spent 17 years in prison for a rape he did not commit may have his prison accommodation costs cut from any compensation he may win. Andrew Malkinson, who is currently living on benefits, said he was 'enraged' he may have to pay for his 'torture'. The 57-year-old was sentenced in 2003 after being found guilty of attacking a woman in Salford. He has always maintained his innocence, and his conviction was overturned on Wednesday by the Court of Appeal. Although Mr Malkinson would not have to reimburse the prison directly, he may have to sacrifice some of his payment to account for costs on the outside had he not been imprisoned. He told the Telegraph: 'The idea of having to pay my torturers, when I heard about it, it just enraged me beyond… I almost couldn't cope with it, the idea. I thought that's so sick. 'Proven innocents have to pay for their torture? What the hell? Are you serious?' Sir Bob Neill, the justice committee chairman, said the Government needed to review the rules governing deductions. 'It was because of the state's activity that this person was wrongly convicted, wrongly imprisoned as it turns out, should they actually then be having a deduction made from that?' Mr Malkinson's case was referred to the Court of Appeal after new evidence was found which pointed to another potential suspect. Greater Manchester Police confirmed they have arrested the new suspected and released them pending further investigation. The court will decide later whether Mr Malkinson's convictions were also unsafe because of what his lawyer Edward Henry KC called 'deplorable disclosure failures, which mostly lay at the door of the Greater Manchester Police'.
