Documents show the DNA of another man was identified three years after Andy Malkinson was wrongly jailed for rape and now Lord Edward Garnier KC wants ‘complete and utter disclosure’
There must be a public inquiry inside six months to find out why a man spent 17 years locked up for a rape he did not commit, a top lawyer has demanded.
Former solicitor general Lord Edward Garnier KC said there has to be a full investigation into the ‘jaw-dropping’ miscarriage of justice that saw Andrew Malkinson spend nearly two decades behind bars. The 57-year-old was found guilty in 2004 of raping a woman in Manchester and only had his conviction quashed last month at the Court of Appeal.
There was public outrage that Mr Malkinson faced deductions of tens of thousands from his future compensation to pay the state for his living costs while wrongly incarcerated. He will not have to pay for his “board and lodgings” in jail after all, but Lord Garnier now wants total and complete disclosure.
Asked what conclusions he has drawn from the case, he told BBC Radio 4’s Today programme: “Jaw dropping shock. I think the more one learns about this case, the more one is shocked about how Mr Malkinson was let down by the justice system. It seems to me that what we need now is complete and utter disclosure, public disclosure, of every document that relates to this case.
