A criminal who kicked two police officers claimed he was unfit for unpaid work – despite going to the gym five times a week and attending a boxing class.
Dene Davies, 30, also lit a pillow with a lighter he managed to smuggle into jail and damaged the home of his ex-partner. A court heard Davies was given unpaid work for assaulting an emergency worker last year, but had not completed any of the hours.
Defending himself, Davies told Worcester Magistrates’ Court he had a medical reason for not doing it. He said: “I’ll do unpaid work, I go to the gym five times a week. If it means me getting out of here (custody) I would go and do it.”
And the plea worked as the university graduate, from Brickfields, Worcester, was spared jail yesterday despite admitting two offences of assault by beating of an emergency worker, and one of arson. Chairman of the Magistrates bench, Martin Soble, gave the defendant an 18-month community order with 24 weeks curfew and 40 days of rehabilitation requirement.
