Just before 2am on July 8, law enforcement received a call regarding someone tampering with an electronic monitoring device at a Texaco gas station on Ponce De Leone Boulevard in Brooksville. At the scene, they were informed by a Federal Department of Corrections Officer that Gardner was the individual in question. Although his ankle monitor was signalling from a 7-Eleven on South Broad Street, they couldn't locate him there. They then found his ankle monitor discarded in a trash can at the gas station. Soon after discovering the monitor, deputies were dispatched to an apartment complex due to a call involving Gardner and an overdose. According to the report, Gardner's sister informed them that her brother had consumed an "unknown narcotic" and overdosed. They found him unconscious on a bed and immediately performed CPR.
